Terms of use
Rules governing access to the website and the use of its services.
Definitions
“Terms of Use” or “Terms” means these Terms governing access to the Website and use of the Services.
“Website” means the website to which the Terms relate.
“Publisher” means the person operating the Website, identified in the legal notice.
“User” means anyone who browses the Website or uses its Services.
“Services” means the features actually offered on the Website and described below.
Purpose and scope
Emilie Schol operates the Website and provides the following Services:
Cosmetic Labs connects users with laboratories and service providers through directory listings, accounts, quote requests and messages. Third-party providers remain responsible for their offers, services and agreements with users.
The Terms define the rights and obligations of the Publisher and the User. They cover only the features offered. Contractual obligations apply only after the User accepts these Terms as described below. Statutory obligations also apply to people who simply browse the Website.
Special terms for a Service supplement these Terms only if they have been brought to the attention of the User and accepted. In a conflict, they take precedence only for that Service.
The legal notice identifies the Publisher. The privacy policy explains how personal data are used and is not a request for consent.
Acceptance of the Terms
Browsing the freely accessible pages of the Website does not constitute contractual acceptance of these Terms. Where a feature requires acceptance, the Publisher lets the User read the Terms before obtaining agreement through an affirmative action, such as ticking a box that is not pre-ticked or activating an acceptance button.
The Publisher retains the accepted version, its date and evidence of that action for the period and in the manner required by law. The Terms remain accessible in a format that allows the User to read and keep them.
Access to and availability of the Service
The User must have, at their own expense, equipment, software and a connection compatible with the Service. Emilie Schol takes reasonable steps to ensure access, security and the proper operation of the Service, without guaranteeing permanent availability or the absence of all errors, subject to the specific service commitments and statutory guarantees.
The Publisher may interrupt the Service to the extent necessary for:
- maintenance
- an update
- the correction of a vulnerability
- the protection of Users
- the management of an incident affecting a provider
- the management of the effects of a force majeure event.
Where circumstances permit, the Publisher announces foreseeable interruptions and limits their duration to the time necessary. An interruption does not, in itself, constitute force majeure and does not deprive the User of remedies, guarantees or refund rights provided by law or by the specific service commitments.
Rules of use
The User must use the Website and its Services for their intended purpose and respect these Terms, the law and the rights of others.
- The User must not publish or transmit unlawful content, including content that is misleading, hateful, defamatory, infringing or violates the rights of others in their privacy, personal data or image.
- The User must also refrain from impersonation, sending unsolicited messages, fraudulent access, introducing malicious code, obstructing the operation of the Service, circumventing security measures and extracting or reusing data in breach of the rights of their holder, without prejudice to statutory exceptions and authorisations.
In the event of a breach, the Publisher may restrict use of the Service only to the extent necessary and proportionate to the nature and seriousness of the facts established, subject to the applicable requirements for reasons and challenges. Suspension or deletion of an account remains subject to the procedure for user accounts.
User accounts
Registration and account security
The Publisher permits registration from the age of 18, subject to rules on legal capacity and authorisation from the legal representative where required. Where the Service is restricted to adults, that restriction prevails over the minimum registration age.
The User must provide accurate information and keep it up to date, limited to the details needed to create and manage the account. The User must keep login credentials confidential, take reasonable precautions to secure the account and promptly report any unauthorised use they become aware of to the Publisher. The mere use of login credentials by a third party is not sufficient to attribute that use to the User.
Closure, suspension and deletion
The User may request account closure using the procedures provided by the Publisher. The Publisher suspends, restricts or deletes an account only for the reasons and according to the following procedure: Accounts may be suspended or closed for serious or repeated breaches of these terms, unlawful use or security risks. Users may contest a decision through emilie@cosmetic-labs.com. Users may request voluntary account closure at the same address. The notice, opportunity to respond and urgent-exception safeguards set out in these terms apply.
Before taking such a measure, the Publisher communicates its reasons to the User and allows the User to submit observations. Where a legal obligation or the need to act immediately to protect the Service or persons prevents this, the Publisher may act without prior consultation. The Publisher then communicates the reasons and available means of challenge as soon as circumstances permit, unless prohibited by law. The Publisher chooses a measure appropriate to the nature, frequency and consequences of the breach.
Account closure does not waive rights or extinguish obligations arising before closure. The treatment of data and content remains governed by the privacy policy, the rules concerning contributions and statutory retention obligations.
Contributions and moderation
Rights in contributions
The User retains the rights attached to the content they publish. By publishing content, the User warrants that they have the rights, authorisations and consents necessary for its publication online and its use within the Service. The licence granted to the Publisher is limited to the following terms: The author retains ownership of their contributions and grants us a non-exclusive, royalty-free licence to store, reproduce and display them solely to operate the service, for their chosen publication period and audience. This licence does not permit unrelated commercial reuse. It ends when the contribution is removed, subject to retention required by law and the time needed to process deletion.
Moderation rules
The Publisher applies the following moderation rules, resources and procedures to contributions: Users can report a contribution to emilie@cosmetic-labs.com by identifying the content and explaining their concerns. We assess the report and the context before deciding whether to restrict access or remove the contribution. Reports and challenges are assessed without discrimination. A person concerned may challenge a decision through the same contact address. No automated moderation or fixed response deadline is asserted.
Reports and challenges
This clause imposes no general obligation on the Publisher to monitor contributions and does not relieve it of any statutory obligation to remove content or intervene. Reports are submitted under the moderation procedures above. The Publisher examines them diligently and impartially, respecting the rights of those concerned.
The Publisher gives reasons for restrictions and allows challenges or human review in the cases and under the procedures required by law. The Publisher may restrict the handling of manifestly unfounded or abusive reports only under the applicable statutory conditions, following individual examination and prior warning where required. Rejection of a report does not in itself establish abuse.
Intellectual property, third-party content and liability
Intellectual property rights
Website elements in which Emilie Schol holds rights or has permission to use, including text, images, videos, distinctive signs, software, graphic elements and databases, remain protected by the rights of their respective holders. The Publisher grants the User a personal, non-exclusive and non-transferable right to view and use the Service in accordance with its intended purpose and these Terms. The User must obtain prior permission from the rights holder before any reproduction, communication to the public, adaptation, extraction or reuse that does not fall within a statutory exception or an expressly granted authorisation.
Informational content
Where the Website provides content for information purposes, the Publisher takes care over its quality and updating, without that content replacing advice tailored to the particular situation of the User. The User remains responsible for checking that the information meets their needs before making a decision based solely on it.
Third-party services and liability
Third-party services accessible through a link remain operated under the responsibility of their own publishers. A link does not constitute approval of their content or an undertaking by the Publisher to provide their services. This allocation does not relieve the Publisher of liability for its own acts or omissions. The Publisher compensates for damage attributable to it under the conditions laid down by applicable law. No provision of these Terms excludes or limits liability that cannot lawfully be excluded or limited, deprives a consumer of the right to compensation, reduces a statutory guarantee, deprives an essential obligation of its substance or creates a significant imbalance between the rights and obligations of the parties.
Changes to the Terms, governing law and dispute resolution
Changes to the Terms
The Publisher may propose a new version of these Terms following changes to the Service or the legal framework. The Publisher publishes it with its effective date and retains successive versions for evidential purposes. Publication of a new version does not, in itself, amend an existing contract. The Publisher brings changes to the attention of the Users concerned before they apply, respecting the periods and procedures required by law, and obtains acceptance where necessary. Otherwise, the previous version continues to govern the existing contract, subject to immediately applicable mandatory provisions. Continued browsing does not, in itself, constitute acceptance of changes.
Governing law and remedies
These Terms are governed by French law, without depriving consumers of the protection of the mandatory provisions of the law of their country of habitual residence. The User and the Publisher may seek an amicable solution to their dispute, but these Terms do not require that step before exercising a remedy. Consumers may refer the matter to the competent mediator if they meet the applicable conditions and bring proceedings before any court having jurisdiction by law, including the court designated by the rules protecting consumers in their place of domicile. The User may send any question or complaint to emilie@cosmetic-labs.com.
General provisions
Force majeure
The party invoking force majeure must establish that the event meets the statutory criteria and prevents performance of the obligation concerned. That party informs the other within a reasonable period and takes reasonable steps to limit its effects. A temporary impediment suspends performance of that obligation unless the delay justifies termination of the contract. Where the impediment is permanent, the contract terminates by operation of law and the parties are discharged under the statutory conditions, including any restitution due.
Preservation and exercise of rights
If a provision is declared void or unenforceable, the remaining provisions stay in force provided that the overall balance of the contract can be preserved. Only documents brought to the attention of the User and accepted by the User form part of the contractual agreement, without prejudice to information and commitments to which the law gives binding effect. Reference to the privacy policy does not give it contractual force and does not constitute consent to processing. A failure by a party to exercise a right immediately does not constitute a waiver of that right. A party may assign rights or obligations arising under these Terms only in compliance with statutory requirements for information, consent and protection, without diminishing the rights of the User.
Personal data and effective date
Where personal data processing relates to access to the Website or use of its Services, the Publisher sets out its conditions in the privacy policy: https://cosmetic-labs.com/compliance/privacy-policy. The Publisher states the purposes, legal bases, recipients, retention periods and rights of data subjects there, according to the processing actually carried out.
This version takes effect on October 25, 2026, subject to the acceptance and amendment provisions of these Terms.
